From Rel 4.5.3 of CEM4, to facilitate immediate understanding of the Risk Assessment has been prepared a new report "RA Complete summary", with which, in addition to the existing video display of the status of the ongoing, Applicability/Compliance with set values and controls in the preview CEM4, you can print/export the overall state of RA in a few pages, and to have an overview the trend/state of Risk Assessment, and not forcibly to all the print/export.
The value of the "PASS CARD VR" is the value that indicates, according to the rating made, if the card is VR PASS Compliance and the requirement for evaluation is "Compliance".

CEM4: Certifico Machinery Directive Software
Important
First and foremost always check the applicability of the machine to other Directives of the "New Approach" which provide for CE marking:
- Dir 2006/95/EC "Low Voltage" (including)
- Dir 2004/108/EC "Electromagnetic Compatibility" (almost always)
- Other eg ATEX , PED , etc., and import the relevant requirements (see Administration standards), proceed to the Risk Assessment (see Risk Assessment customized ) and bring in the EC Declaration of Conformity.
For each machine, you must specify the following information, in order:
1. Master Data Company (Manufacturer);
2. Data of the Project to which the machine (defined for example as a series of models, machine families, orders, etc.);
3. Technical specifications of the machine.
Through the tree structure of the archive in the main window, the user can work on documents needed to administer the requirements of the Machinery Directive: make a Risk Assessment on RESS of the Machinery Directive Risk Assessment on Technical Regulations/Requirements, draft the EC declaration of conformity, organize the Technical Construction File, locate the data plate bearing the CE marking, etc.
Steps 1 and 2 describe the procedure to insert a New Company and a New Project.
Step 3 illustrates the procedure to insert a New Machine.
Each company can have multiple projects and each project can contain multiple machines in turn.
Each machine has its own CEM4 Home summary and a tree structure that represents the Technical File.
In this section you will be treated just inserting New Machines.
For more information on other management functions (move, copy , delete, etc..) Refer to the "Advanced" or the user manual of the product
After starting the software, the main screen is CEM4 Home, composed of the elements shown in the screenshot below.
- On the left side, the module archive and standards, with tree structures for navigation within the database.
- To the right of the work area, in which are shown the information home, newer machines, Legislation, Administration, News, external links.

Introduction to the Update of the 2nd Edition
Directive 2006/42/EC is a revised version of the Machinery Directive, the first version of which was adopted in 1989. The new Machinery Directive has been applicable since 29th December 2009. The Directive has the dual aim of harmonising the health and safety requirements applicable to machinery on the basis of a high level of protection of health and safety, while ensuring the free circulation of machinery on the EU market. The revised Machinery Directive does not introduce radical changes compared with the previous versions. It clarifies and consolidates the provisions of the Directive with the aim of improving its practical application.
While the revised Machinery Directive was being discussed by the Council and the European Parliament, the Commission agreed to prepare a new Guide to its application.
The purpose of the Guide is to provide explanations of the concepts and requirements of Directive 2006/42/EC in order to ensure uniform interpretation and application throughout the EU. The Guide also provides information about other related EU legislation. It is addressed to all of the parties involved in applying the Machinery Directive, including machinery manufacturers, importers and distributors, Notified Bodies, standardisers, occupational health and safety and consumer protection agencies and officials of the relevant national administrations and market surveillance authorities. It may also be of interest to lawyers and to students of EU law in the fields of the internal market, occupational health and safety and consumer protection.
It should be stressed that only the Machinery Directive and the texts implementing its provisions into national law are legally binding.
Following discussion with the industry, the comments relating to chains, ropes and webbing for lifting purposes in §44, §330, § 340, §341, and §357 have been revised in order to clarify the practical application of the requirements relating to these products.
The 2nd Edition also includes a thematic index to facilitate consultation of the Guide. The numbering of the sections of the Guide is unchanged.
The Guide takes account of the amendment to Directive 2006/42/EC introduced by Regulation (EC) No 569/2009 relating to the regulatory procedure with scrutiny for the Machinery Committee. It also takes account of the provisions of Regulation (EC) No 765/2008 relating to market surveillance, which apply in a complementary way.
The 1st Update to the 2nd Edition of the Guide, further named Edition 2.1, has been completed to include the amendments made to the Machinery Directive by the Directive 2009/127/EC on Pesticide Equipment and the Regulation (EU) No 167/2013 on the approval and market surveillance of agricultural and forestry vehicles (Tractors). In addition, guidance on “partly completed machinery” and “assemblies” has been added, as well as inserting clarifications and corrections to the concepts of "safety components'', "new and used machinery", "marking of machinery". A number of key guidance decisions of the Machinery Working Group have been incorporated into this text.
This Update to the 2nd Edition of the Guide, further named Edition 2.2, contains a number of clarifications and corrections to the concepts of “safety components” and “partly completed machinery”, and some edits to ensure coherence with the LVD Guide. There are two newly added paragraphs about the machinery control units (§417) and safety components which are considered to be logic units (§418).
The Guide is published on the Commission’s Website EUROPA in English. This updated Edition 2.2 is intended to be a living document, edited and updated with new guidance once approved by the Machinery Working Group. It might be made available in other EU languages, but only the English version will be checked by the Commission.
Therefore, in case of doubt, the English version should be taken as the reference.
The Guide can be downloaded and is presented in a printable format. The text of the Directive is presented in boxed red italic type - the comments follow in black type. The Guide has been prepared with the help of an Editorial Group2. The previous Update of the 2nd Edition has been carried out by an external consultant3 and the Commission, assisted by some of the members of the Editorial Group. This Update has been carried out by the Commission services based on the input from the Editorial Group. The Commission4 wishes to warmly thank the members of the Editorial Group both for the huge amount of work they have carried out as well as for the efficient, constructive and cooperative spirit in which the drafts have been prepared. In parallel to the work of the Editorial Group, a Machinery Core Group established by Orgalime, including representatives of the main sectors of machinery manufacturing, has provided invaluable input from the industry. The drafts prepared by the Editorial Group have been submitted to the Member States and stakeholders for comments. The Commission would also like to thank all those who have made comments. We have tried to take them into account as far as possible.
Of course, the Commission takes full responsibility for the content of the Guide. Readers are invited to communicate any corrections or comments so that they can be taken into account in preparing future updates or a revised 3rd Edition.

Directive 2006/42/EC "Machinery"
This mandate relates to Directive 2006/42/EC of the European Parliament and of the Council of 17 May 2006 on machinery, and amending Directive 95/16/EC1 . This Directive is a revision (recast) of the current Machinery Directive 98/37/EC.
It came into force on 29 June 2006. Its provisions must be transposed into the national law of the Member States by the 29th June 2008 and will become applicable on 29 December 2009. According to Article 5 of the revised Directive, machinery subject to the Directive must satisfy the relevant essential health and safety requirements set out in Annex I before being placed on the market. Article 7 of the revised Directive states that machinery manufactured in conformity with a harmonised standard, the references of which have been published in the Official Journal of the European Union, shall be presumed to comply with the essential health and safety requirements covered by the standard. The scope of the revised Directive, set out in Article 1, is extended in so far as certain types of machinery have been removed from the list of exclusions.
The borderline between the scope of the Machinery Directive and other Directives, in particular, the Low Voltage Directive, 73/23/EEC, and the Lifts Directive, 95/16/EC4, have been redefined in order provide greater legal certainty. Compared with the current Machinery Directive, Annex I to Directive 2006/42/EC does not introduce major changes to the essential health and safety requirements applicable to machinery. However, several of these requirements, such as those relating to ergonomic principles and machine emissions, have been made more precise.
A limited number of new essential health and safety requirements have been introduced to deal with risks associated with the types of machinery brought into the scope of the Directive. Furthermore, certain requirements that are currently applicable only to mobile or lifting machinery have been made applicable to any machinery presenting the risks concerned

La Direttiva 2000/14/CE, concernente l’emissione acustica ambientale delle macchine ed attrezzature destinate a funzionare all’aperto, comunemente detta “OND” (Outdoor Noise Directive), riguarda le macchine rientranti in direttiva macchine 2006/42/CE, semoventi o mobili, destinate a funzionare all’aperto.
Una macchina soggetta a Direttiva OND, è, quindi, sicuramente una macchina che deve sottostare agli obblighi della direttiva macchine 2006/42/CE, più a tutti gli obblighi della Direttiva 2000/14/CE.
Nella Direttiva si fa riferimento a 57 tipi di macchine ed attrezzature definite in Allegato I (Parte A), per ognuna di esse se ne da:
- Definizioni Allegato I (Parte A)
- Elenco Macchine ed attrezzature soggette a limiti di emissione acustica Allegato I (Parte B) (Art. 10)
- Elenco Macchine ed attrezzature soggette solo alla marcatura Allegato I (Parte C)
In allegato III sono indicati i Metodi di misurazione del rumore aereo per ciascun tipo di attrezzatura (Parte B)
Per tali macchine deve essere indicato il livello di potenza sonora (livello di potenza sonora ponderato A in dB riferito a 1 pW quale definito in EN ISO 3744 e EN ISO 3746)

9° Rapporto 2017 sull'attività di sorveglianza del mercato ai sensi del d.lgs. 17/2010 per i prodotti rientranti nel campo di applicazione della Direttiva Macchine
Il documento fornisce analisi e informazioni di supporto al monitoraggio e all'ottimizzazione dell’azione di Sorveglianza del Mercato, oltre a contenuti di indirizzo, per sviluppare nuove linee di ricerca e prodotti di supporto all'individuazione delle soluzioni adeguate per la totalità dell’utenza di settore.
L'Inail, in base a quanto previsto dal comma 2 dell’art. 6 del d.lgs. 17/2010 (ex comma 2 dell’art. 7 del d.p.r. 459/96), conduce attività di accertamento tecnico in supporto all'autorità italiana preposta alla sorveglianza del mercato (Ministero dello Sviluppo Economico e Ministero del Lavoro e delle Politiche Sociali). In particolare, all'intero del Dipartimento innovazioni tecnologiche e sicurezza degli impianti, prodotti e insediamenti antropici di Inail è istituita la sezione tecnico scientifica accertamenti tecnici, che coordina a livello nazionale le attività di valutazione della conformità di macchine, impianti, apparecchi e prodotti ai requisiti di sicurezza prescritti dalle disposizioni legislative di recepimento delle direttive di prodotto applicabili.
La banca dati che Inail ha negli anni composto per gestire le informazioni relative a detta attività di accertamento tecnico rappresenta una sintesi di tutte le informazioni su cui si fonda il processo di sorveglianza del mercato e costituisce, pertanto, un insostituibile strumento di analisi e monitoraggio, offrendo indirizzi e supporto a tutti i soggetti coinvolti, a vario titolo, nella filiera (organi preposti alla vigilanza nei luoghi di lavoro, fabbricanti, datori di lavoro, ecc.).
Il 9° Rapporto, previsto dall'art. 3 del decreto direttoriale prot. 11972 del 15 dicembre 2004, costituisce la sintesi organizzata dei dati contenuti nell'archivio informatico di Inail: partendo dalle segnalazioni di presunta non conformità di organi di vigilanza, Inail, magistratura, altri stati membri, ecc., viene ricostruito il meccanismo che, attivando un percorso di confronto tra le autorità e i fabbricanti, punta a garantire, nel rispetto delle prescrizioni della Direttiva Macchine, livelli minimi di sicurezza per i lavoratori. A valle di questo contraddittorio tra i soggetti preposti all'attività di sorveglianza e i fabbricanti, infatti, sono stati realizzati, condividendo strategie e soluzioni a breve e lungo termine, interventi migliorativi sia sul parco macchine già immesso sul mercato, sia sulle nuove produzioni, a dimostrazione della possibilità di superare la logica controllato/controllore/sanzione per giungere alla più efficace collaborazione tra le diverse parti interessate, nell'ottica di un incremento continuo dei livelli di sicurezza per gli operatori delle macchine e, più in generale, dei lavoratori.
Il documento prevede:
- un primo capitolo in cui viene offerta una panoramica dell’attività di sorveglianza, che parte dai dati riguardanti le segnalazioni di presunta non conformità (soggetti segnalanti e motivi di segnalazione), per passare poi all'analisi delle risultanze finora definite dall'autorità e a un esame più specifico in base al paese di origine del fabbricante e alla procedura di valutazione della conformità adottata;
- un secondo capitolo che ripropone l’intero percorso di sorveglianza, trattato per ciascuna regione, analizzando il numero delle segnalazioni pervenute con l’esplicitazione della tipologia di macchina e del motivo da cui origina la segnalazione e le corrispondenti risultanze ad oggi definite;
- un terzo capitolo dedicato alle singole tipologie di macchina, che analizza le risultanze definite per ciascuna tipologia e approfondisce l’esame dei requisiti di sicurezza risultati non conformi o resi conformi.
Il Rapporto si inserisce nell'ambito dell’attività di ricerca sul “knowledge management delle tecnologie di sicurezza” come elemento di avvio di un processo che, partendo dalla rilevazione delle criticità emerse sulle macchine in uso, possa arrivare alla definizione di linee di indirizzo per le attività di valutazione della conformità e verifica e all'identificazione di soluzioni tecniche innovative, in grado di assicurare livelli di sicurezza crescenti degli ambienti di lavoro. L’interpretazione dei dati emersi nel Rapporto, infatti, può costituire, se adeguatamente indirizzata, uno strumento di supporto sia all'attività di verifica e controllo condotta dall'Inail, dagli organi di vigilanza territoriale e dai soggetti abilitati, sia al processo di continuo miglioramento che vede impegnati i fabbricanti.
Il 9° Rapporto Inail, in conclusione, con obiettivi e finalità immutate, fornisce analisi e informazioni per il monitoraggio e l’ottimizzazione dell’azione di sorveglianza del mercato al servizio dei soggetti che a vario titolo (costruttori, utilizzatori, distributori, soggetti istituzionali e non) sono in essa coinvolti, oltre a contenuti di indirizzo, per sviluppare nuove linee di ricerca e prodotti di supporto all'individuazione delle soluzioni adeguate per il complesso dell’utenza di settore.

Dalla Versione CEM4 4.8.9 di Ottobre 2017 è modificato il Report di Valutazione del rischio RESS/Pericoli per l’inserimento del valore numerico/grafico della riduzione del rischio in riferimento alle matrici di stima del metodo ibrido ISO/TR 14121-2:2012 p. 6.5 (Fig. 1) confrontato tra la stima del rischio iniziale e finale/residuo (Fig. 2).

Tale valore inserito alla fine del report, darà un’evidenza immediata della riduzione effettuata (Fig. 3).

Alert di controllo
Prima della stampa/anteprima/esportazione del report di analisi è inserito un alert a seguito dei seguenti controlli:
1. il valore numerico della stima finale non deve essere superiore a quello iniziale;
2. a parità di valore numerico la gravità selezionata nella stima finale non deve essere superiore a quella iniziale.

Article 51 Repeals
2. Directive 2006/42/EC is repealed with effect from 20 January 2027.
Directive 2006/42/EC is a revised version of the Machinery Directive, the first version of which was adopted in 1989. The new Machinery Directive has been applicable since 29th December 2009. The Directive has the dual aim of harmonising the health and safety requirements applicable to machinery on the basis of a high level of protection of health and safety, while ensuring the free circulation of machinery on the EU market. The revised Machinery Directive does not introduce radical changes compared with the previous versions. It clarifies and consolidates the provisions of the Directive with the aim of improving its practical application.
While the revised Machinery Directive was being discussed by the Council and the European Parliament, the Commission agreed to prepare a new Guide to its application. The purpose of the Guide is to provide explanations of the concepts and requirements of Directive 2006/42/EC in order to ensure uniform interpretation and application throughout the EU. The Guide also provides information about other related EU legislation. It is addressed to all of the parties involved in applying the Machinery Directive, including machinery manufacturers, importers and distributors, Notified Bodies, standardisers, occupational health and safety and consumer protection agencies and officials of the relevant national administrations and market surveillance authorities. It may also be of interest to lawyers and to students of EU law in the fields of the internal market, occupational health and safety and consumer protection.
It should be stressed that only the Machinery Directive and the texts implementing its provisions into national law are legally binding.
The Guide is published on the Commission’s Website EUROPA in English. This updated Edition 2.1 is intended to be a living document, edited and updated with new guidance once approved by the Machinery Working Group. It will be made available in other EU languages, but only the English version will be checked by the Commission. Therefore, in case of doubt, the English version should be taken as the reference.
The Guide can be downloaded and is presented in a printable format. The text of the Directive is presented in boxed red italic type - the comments follow in black type.
The Guide has been prepared with the help of an Editorial Group2 and this Update of the 2nd Edition has been carried out by an external consultant and the Commission, assisted by some of the members of the Editorial Group. The Commission4 wishes to warmly thank the members of the Editorial Group both for the huge amount of work they have carried out as well as for the efficient, constructive and cooperative spirit in which the drafts have been prepared. In parallel to the work of the Editorial Group, a Machinery Core Group established by Orgalime, including representatives of the main sectors of machinery manufacturing, has provided invaluable input from the industry. The drafts prepared by the Editorial Group have been submitted to the Member States and stakeholders for comments. The Commission would also like to thank all those who have made comments. We have tried to take them into account as far as possible.

Il presente Documento, estratto da EN ISO 12100 e ISO/TR 14121-2 mette in evidenza l'applicazione congiunta delle due norme, l'esempio riportato nell'Appendice A dell’ISO/TR 14121-2 è analizzato anche in CEM4 con l’elaborazione del Report parallelo all'esempio della norma.
